Use of a provisioned operator account is additionally governed by the subscription terms or order form presented at or after signup; if those conflict with these Terms, the subscription terms control for the platform.
01Acceptance of these Terms
By accessing the site, submitting a signup request, or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service. If you accept on behalf of a business, you represent that you have authority to bind that business.
02Eligibility
The Service is offered exclusively to licensed cannabis businesses and their authorized personnel. You must be at least 21 years old to use the Service. By signing up you represent that your business holds, and will maintain, all licenses required to operate in its jurisdiction.
03Accounts and accurate information
You agree that all information you submit — in a contact or signup request and in your account — is accurate, current, and complete, and that you will keep it up to date. You are responsible for safeguarding account credentials and for all activity under your account. Notify us promptly of any unauthorized use.
04Acceptable use
You agree not to:
- use the Service in violation of applicable law or to facilitate unlicensed activity;
- probe, scan, or test the vulnerability of the Service, bypass authentication or tenant-isolation measures, or access data of another tenant;
- interfere with the Service's operation, including by introducing malware or imposing an unreasonable load;
- scrape, harvest, resell, or reverse engineer the Service except as permitted by law;
- use the Service to send unlawful, deceptive, or unsolicited communications (including SMS in violation of applicable telecommunications rules).
05Intellectual property
The Service — including its software, design, text, graphics, and logos — is owned by Kamui or its licensors and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for your business's internal operations. Your business data remains yours; you grant us the rights needed to host and process it to provide the Service.
06Subscriptions and billing
The platform is offered in plan tiers (currently Starter, Growth, and Enterprise) as described on the pricing section of this site. Subscription fees, billing cycles, and any trial terms are set out in your order form or at checkout. Payments are processed by Stripe; Kamui does not store full payment-card numbers. Prices shown on the site may be placeholders and are subject to the final order form.
07Regulatory compliance disclaimer
Cannabis remains subject to complex and changing federal, state, and local law. You are solely responsiblefor your business's regulatory compliance — including state cannabis law, licensing, labeling, taxation, and telecommunications rules. The platform is an operational tool; it is not legal advice, and using it does not ensure compliance with any law or regulation.
08Service metrics and telemetry
You acknowledge and agree that Kamui collects usage metrics and related telemetry from the Service — such as feature usage, device and browser data, and performance and reliability measurements — to operate, secure, and improve the Service, as described in the Privacy Policy. Kamui may use aggregated or de-identified data derived from the Service for analytics and product development.
09Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAMUI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO KAMUI IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE (OR ONE HUNDRED U.S. DOLLARS IF YOU HAVE PAID NOTHING).
11Termination
We may suspend or terminate your access to the Service if you breach these Terms, if your business loses a required license, or if required by law. You may stop using the Service at any time; subscription cancellation and data-export terms are set out in your order form. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) survive.
12Changes to these Terms
We may revise these Terms from time to time. We will post the revised Terms here and update the "Last updated" date above; material changes will be notified to account holders by email or an in-product notice. Continued use of the Service after changes take effect constitutes acceptance.
13Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The exclusive venue for disputes arising out of these Terms is the state or federal courts located in California, and each party consents to their jurisdiction.
